Abstract: this article upholds that human rights must be understood as a kind of moral right if they are to fulfill the role of supervising the exercise of political power. it discards iusnaturalism and logical positivism as plausible answers to the problem of whether or not it is possible to rationally defend certain basic moral principles. finally, it concludes that rawlsian constructivism is an intermediate route that is able to articulate strong reasons for adopting certain moral principles, those that will constitute bases for the ultimate justification that human rights require.
