El derecho a la educación como un derecho humano fundamental a la luz de la Constitución de 1999Keywords: education, fundamental right, human right, state, social justice, missions. Abstract: this research project analyzes the right to education as a fundamental human right according to the concept of a social state of rights and justice, foreseen in the 1999 constitutional text. likewise, using the comparative method, the substantial changes in the same with regard to the 1961 constitution are analyzed, at the same time indicating that during the research, the absence of a legislative framework that updates and develops them was observed. finally, the plans and/or programs implemented since the constitution of the republic of venezuela went into effect and that are consecrated to developing and guaranteeing its exercise by the current government are analyzed. conclusions are that the current constitution is very novel, broader and establishes more concrete means for true development of the right to education, where the participation of society, the family and the state plays a fundamental leading role.
