Abstract:

本文通过符号资本理论、场景化权利学说和比较法研究,形象化说明数字时代音乐作品标题在文化传播与商业利用中的价值冲突。用研究具体案例的方式,发现传统商标法里判断商标是不是特别、好识别的标准,在现在情感经济的环境里不适用。所以他们提出了“动态驰名认定机制”和“情感显著性”的新理论。此外像一些音乐的标题,因为有文化意义、能勾起大家的感情,还能开发出很多商业用途,价值变得越来越高。基于这些,应该建立一套能深入了解不同情况的判断原则,还要有一个能提前发现侵权的系统,防止乱用音乐标题谋取利益。此研究对完善数字时代文化知识产权保护体系具有极大帮助,既保障了创作者的权益,也能促进相关产业的创新发展。
This article uses symbolic capital theory, scenario based rights theory, and comparative law research to vividly illustrate the value conflict of music titles in cultural dissemination and commercial utilization in the digital age. By studying specific cases, it was found that the criteria for determining whether a trademark is special and easy to identify in traditional trademark law are not applicable in the current emotional economy environment. So they proposed new theories of “dynamic well-known recognition mechanism” and “emotional salience”. In addition, some music titles, due to their cultural significance, ability to evoke emotions, and potential commercial applications, have become increasingly valuable. Based on these, a set of judgment principles that can deeply understand different situations should be established, and there should also be a system that can detect infringement in advance to prevent the misuse of music titles for profit. This study is of great help in improving the cultural and intellectual property protection system in the digital age, which not only safeguards the rights and interests of creators, but also promotes the innovative development of related industries.
