以伦理学视角分析竞业限制问题

Abstract:
在竞争激烈的当今社会中,企业通过竞业限制协议保障自身的商业机密、知识产权已成为普遍现象。在此过程中,对劳动者的权利产生了限制,因而存在一定的劳资伦理冲突。本文通过道德终极标准体系和社会治理道德原则对竞业限制协议进行伦理学分析,探讨其利益平衡与伦理边界。
In today’s highly competitive society, it has become a common phenomenon for enterprises to safeguard their trade secrets and intellectual property rights through non-compete agreements. During this process, restrictions were imposed on the rights of workers, thus resulting in certain ethical conflicts between labor and capital. This article conducts an ethical analysis of non-compete agreements through the ultimate moral standard system and the moral principles of social governance, and explores their interest balance and ethical boundaries.
