数据在当前数字经济迅猛发展的时代背景下逐渐成为市场竞争的重要资产，深刻影响着企业制定战略决策、实施业务创新以及规划市场布局等，企业如果能高效地利用数据信息资源将会显著推动其数字化转型并在市场竞争中抢占先机。然而部分经营者却采用不正当数据抓取技术窃取同行的数据信息，这种行为侵犯他人合法权益的同时还严重扰乱了公平竞争的市场秩序。因此亟需通过《反不正当竞争法》对不正当的数据抓取行为进行严格规范从而维护市场环境的公正性，但是在实施过程中法规条文的模糊性、评判标准的滞后性以及监管机制的不完善等问题逐渐暴露出来，创建一个多元共治的监管框架迫在眉睫。
In the era of rapid digital economic development, data has increasing become a critical asset in market competition, profoundly influencing enterprises’ strategic decision-making, business innovation, and market layout planning, enterprises capable of efficiently leveraging data resources can significantly accelerate their digital transformation and secure a competitive advantage in the market. However, some operators employ improper data scraping techniques to illicitly acquire competitors’ data, which not only infringes upon others’ lawful rights and interests but also severely disrupts the fair market competition order. Consequently, it is imperative to strictly regulate such improper data scraping practices under the Anti-Unfair Competition Law to safeguard the fairness of the market environment. Nevertheless, during implementation, issues such as ambiguous legal provisions, outdated evaluation standards, and incomplete regulatory mechanisms have emerged. Therefore, it is crucial to establish a multi-party governance framework for regulation.
