专利恶意诉讼行为的反不正当竞争法规制研究

随着市场经济飞速发展，知识产权与创新成为市场主体的重要发展动力，专利相关的诉讼数量逐年上升，其中不乏滥用专利权以谋取非法利益的行为，即专利恶意诉讼。该行为不仅损害了正常市场主体的合法权益，还破坏了市场竞争秩序以及司法公正。本文通过袁某的案例引入主题，分析了将专利恶意诉讼作为不正当竞争行为规制的必要性以及可行性，并针对此过程中可能出现的问题给出相应的可行性建议，以期完善专利恶意诉讼行为的有效规制。
With the rapid development of the market economy, intellectual property and innovation have become important driving forces for market entities. The number of patent related lawsuits has been increasing year by year, including the abuse of patent rights to seek illegal benefits, known as malicious patent litigation. This behavior not only damages the legitimate rights and interests of normal market entities, but also undermines market competition order and judicial fairness. This article introduces the theme through the case of Yuan Lizhong, analyzes the necessity and feasibility of regulating malicious patent litigation as unfair competition behavior, and provides corresponding feasible suggestions for possible problems in this process, in order to improve the effective regulation of malicious patent litigation behavior.
