Abstract:

研究探讨了数字化时代下生成式人工智能在司法裁判中的前景与风险,并提出通过技术赋能,生成式人工智能可在证据展示、文书制作、裁判辅助等方面极大提升司法效率和透明度。当前,针对技术的深入应用存在内容可控性与真实性、裁判逻辑、以及司法伦理和监管保障等系列问题,研究提出“辅助为主、审查为要”的应用模式,强调人工智能技术与司法经验的协作,以确保法律裁判的可控性与公正性。
The study explores the prospects and risks of generative artificial intelligence in judicial adjudication in the digital era, and proposes that through technological empowerment, generative artificial intelligence can greatly enhance judicial efficiency and transparency in the areas of evidence presentation, document production, and adjudication assistance. However, the in-depth application of the technology still has a series of problems such as content controllability and authenticity, adjudication logic, as well as judicial ethics and regulatory safeguards. In order to address these challenges, the study proposes an application model of “assistance as the mainstay, review as the mainstay”, which emphasizes the collaboration between artificial intelligence technology and judicial experience, in order to ensure the controllability and fairness of legal adjudication.
