互联网平台知情同意规则的适用规制探析

知情同意规则作为个人信息保护的核心规则，在《个人信息保护法》中已予以明确规定。然而，随着互联网经济的蓬勃发展，知情同意规则在实践中面临诸多困境，包括平台告知义务的缺失引发的用户同意这一意思表示的非真实性、用户隐私泄露等问题。为此，有必要规范知情同意规则，明确平台的告知义务；同时构建多元化的救济模式，完善损害赔偿机制，建立行业自律，共同致力于维护网络用户的合法权益，为互联网经济的健康、有序发展筑牢根基。
As the core rule of personal information protection, the rule of informed consent has been clearly stipulated in the Personal Information Protection Law. However, with the booming development of the Internet economy, the rule of informed consent is facing many difficulties in practice, including the lack of the platform’s obligation to inform the user of the non-authenticity of the expression of consent and the leakage of the user’s privacy. For this reason, it is necessary to regulate the rules of informed consent and clarify the notification obligations of platforms; at the same time, it is also necessary to construct diversified relief modes, improve the mechanism of compensation for damages, and establish industry self-regulation, so as to work together to safeguard the lawful rights and interests of network users, and lay a solid foundation for the healthy and orderly development of the Internet economy.
