论我国韧性城市建设的法制保障
On the Legal Guarantee of Resilient City Construction in China

本文探讨了我国韧性城市建设的法制保障问题，提出了韧性城市建设的重要性及其在法律层面上面临的挑战。然后，分析了当前韧性城市顶层设计及相关制度的困境，如政策法治化制度基础薄弱、政府部门角色定位模糊、缺乏统一的技术标准法治支撑等。为应对这些问题，文章提出了韧性城市法制保障的制度设计，包括明确韧性城市建设的法律依据、提升韧性城市的制度响应、优化技术标准体系等具体措施。最后，强调韧性城市政策的法治化对于推进国家治理体系和治理能力现代化、提升城市安全水平和可持续发展能力的重要性。
This paper discusses the issue of legal guarantee for the construction of resilient cities in China and it puts forward the importance of resilient city construction and the challenges it faces at the legal level. Then, it analyzes the current dilemmas of the top-level design of resilient cities and related systems, such as the weak foundation of the policy rule of law system, the ambiguity of the role of government departments, and the lack of unified technical standards supported by the rule of law. In order to cope with these problems, the article proposes the system design of the legal system guarantee for resilient cities, including specific measures such as clarifying the legal basis for resilient city construction, enhancing the institutional response of resilient cities, and optimizing the technical standard system. Finally, it emphasizes the importance of the rule of law for the policy of resilient cities to promote the modernization of the national governance system and governance capacity, and to enhance the level of urban safety and sustainable development capacity.
