数字代际差异背景下老年人权益保护路径研究

Abstract:

本研究旨在探讨数字代际差异背景下老年人权益保护的现实困境与优化路径。通过文献分析、典型案例研究及政策文本评估方法,系统考察老年群体在数字化进程中面临的技术适应障碍、隐私安全风险和信息获取壁垒,揭示数字权益受损的制度性成因与社会影响机制。研究发现,当前老年人数字权益保护存在法律体系碎片化、技术适老化不足、社会支持网络缺位三重困境,数字代际差异主要由技术接入能力、数字素养水平和智能设备适配度三大因素共同形塑。基于社会公平理论与包容性治理框架,提出构建“制度保障–技术赋能–社会协同”三位一体的综合治理体系:立法层面应制定《数字适老化促进条例》,明确数字服务主体的适老化义务;技术研发需建立“需求导向型”适老化标准,开发智能辅具与数字培训平台;社会层面倡导代际数字反哺机制,建立政府主导的跨部门协作网络。研究结论强调,通过制度创新与技术赋能的协同推进,可有效弥合数字代际鸿沟,促进社会公平与代际和谐,助力包容性数字社会建设。
The purpose of this study is to explore the realistic dilemma and optimization path of the protection of the rights and interests of the elderly under the background of digital intergenerational differences. Through literature analysis, typical case studies and policy text evaluation methods, this paper systematically examines the technological adaptation barriers, privacy security risks and information access barriers faced by the elderly in the process of digitization, and reveals the institutional causes and social impact mechanisms of the damage to digital rights and interests. The study found that the protection of digital rights and interests of the elderly currently has three dilemmas: fragmentation of legal system, insufficient aging technology, and absence of social support network. The difference between digital generations is mainly shaped by three factors: technology access ability, digital literacy level, and the fitness of smart devices. Based on the theory of social equity and the inclusive governance framework, it is proposed to build a three-in-one comprehensive governance system of “institutional guarantee, technology empowerment and social coordination”: At the legislative level, the Regulation on Digital Age-Appropriate Promotion should be formulated to clarify the age-appropriate obligations of digital service entities; Technology research and development should establish “demand-oriented” aging standards, develop intelligent AIDS and digital training platforms; At the social level, we should advocate an intergenerational digital feedback mechanism and establish a government-led cross-departmental collaboration network. The conclusion of the study emphasizes that the collaborative promotion of institutional innovation and technological empowerment can effectively bridge the digital intergenerational divide, promote social equity and intergenerational harmony, and contribute to the construction of an inclusive digital society.
