论校园暴力的刑事法治理

近年来，未成年人身心健康受到严重威胁，校园暴力事件层出不穷，成为社会各界普遍关注的焦点。此类事件不仅扰乱了校园的安宁与秩序，更对青少年的成长环境造成了深远影响。面对校园暴力这一严峻挑战，仅仅依靠道德教育和学校管理还远远不够，必须运用法治思维和法治方式，充分发挥刑事法律的威慑和惩戒作用，构建起预防和惩治校园暴力的长效机制。文章将从校园暴力的现状、特点及危害入手，分析现行刑事法律在治理校园暴力方面存在的不足，并借鉴国外相关经验，提出完善我国校园暴力刑事法治理的对策建议，以期为构建平安校园、保护未成年人健康成长提供有益参考。
In recent years, the physical and mental health of minors has been seriously threatened, and school violence incidents have occurred frequently, becoming a focus of widespread concern in all sectors of society. Such incidents not only disrupt the peace and order of schools but also have a profound impact on the growth environment of teenagers. Facing the severe challenge of school violence, relying solely on moral education and school management is far from enough. It is necessary to apply the thinking and methods of the rule of law, give full play to the deterrent and punitive role of criminal law, and establish a long-term mechanism for the prevention and punishment of school violence. This article will start from the current situation, characteristics, and hazards of school violence, analyze the deficiencies of the current criminal law in governing school violence, and draw on relevant foreign experiences to put forward countermeasures and suggestions for improving the criminal law governance of school violence in China, with the aim of providing useful references for building a safe campus and protecting the healthy growth of minors.
