大数据时代下网络平台用户权益保护研究

在大数据时代背景下，网络平台作为信息社会的重要组成部分，其广泛应用不仅改变了商业模式，也对用户权益保护提出了新的挑战。研究发现，尽管我国已经出台了一系列法律法规，如《网络安全法》和《个人信息保护法》，但在实际操作中，由于法律滞后、监管不足及执行不力等因素，导致用户数据泄露、隐私侵犯等问题频发。此外，平台算法透明度低、用户协议不公平等现象进一步加剧了用户权益受损的风险。文章指出必须采取完善的相关法律体系、强化政府监管与平台自律机制、提升司法保障和纠纷调解效率、拓宽资金支持渠道等手段维护网络用户的合法权益，通过多方协作，构建健全的用户权益保护体系，是实现数字经济健康发展的关键所在。
In the context of the big data era, the widespread application of online platforms as an important part of the information society has not only changed the business model, but also posed new challenges to the protection of users’ rights and interests. The study found that although China has introduced a series of laws and regulations, such as the “Cybersecurity Law” and the “Personal Information Protection Law”, in practice, factors such as lagging laws, insufficient supervision and ineffective implementation have led to frequent problems such as leakage of users’ data and privacy infringement. In addition, the low transparency of platform algorithms and unfair user agreements further exacerbate the risk of damage to user rights and interests. The article points out that it is necessary to improve the relevant legal system, strengthen government supervision and platform self-regulation mechanism, enhance the judicial guarantee and dispute mediation efficiency, broaden the financial support channels and other means to safeguard the legitimate rights and interests of network users, through the collaboration of multiple parties, to build a sound user rights and interests protection system, is the key to the realization of the healthy development of the digital economy.
