非遗数字化成果著作权保护的现实困境及优化路径
The Practical Dilemmas and Optimization Paths of Copyright Protection for Digitalization Achievements of Intangible Cultural Heritage

伴随国家文化数字化战略推进，非遗数字化发展趋势迅猛，但非遗数字化成果的著作权保护问题存在诸多难题。基于此，本文从著作权法理论出发，从独创性、智力成果、表现形式三要件论证非遗数字化成果的可版权性。当前，非遗数字化成果存在权利归属与内容不明、惠益分享及限制适用规则模糊等诸多困境。本文提出可以通过明晰权利主体边界及内容，构建惠益分享规则与知识产权交易机制，为非遗数字化成果著作权保护提供制度支撑。
With the advancement of the national cultural digitalization strategy, the trend of digitalization of intangible cultural heritage (ICH) is developing rapidly. However, there are many challenges in the copyright protection of digitalized ICH achievements. Based on this, this paper starts with the theory of copyright law and argues the copyrightability of digitalized ICH achievements from the three elements of originality, intellectual achievements, and expression forms. Currently, digitalized ICH achievements face many difficulties such as unclear rights ownership and content, ambiguous benefit-sharing and restricted application rules. This paper proposes that by clarifying the boundaries and contents of rights holders, establishing benefit-sharing rules and intellectual property transaction mechanisms, it can provide institutional support for the copyright protection of digitalized ICH achievements.
