我国生产者责任延伸制度的立法问题研究
Study on the Legislative Issues of the Extended Producer Responsibility System in China

就我国当前推行的生产者责任延伸制度而言，仍然存在许多不足之处。主要原因是立法者没有给予生产者责任延伸制度一个完整的体系，仅仅只在零零散散的法律条文中点明某些废物实行生产者责任延伸制度，并未全面地分析生产者责任延伸制度所需要的法律规范。对社会大众以及作为生产者的企业所追究的法律责任不够明确，往往止步于“倡导”“鼓励”等词汇。因此笔者认为对我国生产者责任延伸制度的法律体系进行梳理，探究其不足与缺陷能够更好地帮助我们了解生产者责任延伸制度的前世今生，增强社会大众对生产者责任延伸制度的意识，促进我国生产者责任延伸制度的实施与完善。
As far as the extended producer responsibility (EPR) system currently implemented in China is concerned, there are still many shortcomings. The main reason is that the legislator has not given the extended producer responsibility system a complete system, only in the scattered legal provisions pointing out the implementation of the extended producer responsibility system for certain wastes, and has not comprehensively analyzed the legal norms required for the extended producer responsibility system. The legal responsibility of the public and enterprises as producers is not clear enough, often stops at “advocate” “encourage” and other terms. Therefore, the author believes that sorting out the legal system of China’s extended producer responsibility system, and exploring its shortcomings and defects can better help us understand the past and present life of the extended producer responsibility system, enhance the public awareness of the extended producer responsibility system, and promote the implementation and improvement of China’s extended producer responsibility system.
