行政法对非物质文化遗产保护的路径探究

非物质文化遗产(以下简称“非遗”)是民族文化的传承根基，其保护在全球化背景下显得尤为重要。作为一种灵活的公共治理手段，行政法能够在非遗保护中发挥独特作用。然而，现行法律体系中，行政法在执行和保护非遗方面仍存在显著不足，亟需探索更加科学的完善路径。本文探讨了行政法对非遗保护的独特优势、面临的多维困境及其成因，并从多角度提出应对之策，以期为非遗保护的法治化提供新思路。
Intangible cultural heritage (hereinafter referred to as “intangible cultural heritage”) is the foundation of national culture inheritance, and its protection is particularly important in the context of globalization. As a flexible means of public governance, administrative law can play a unique role in the protection of intangible cultural heritage. However, in the current legal system, administrative law still has significant deficiencies in the implementation and protection of intangible cultural heritage, and it is urgent to explore a more scientific and perfect path. This paper discusses the unique advantages, multi-dimensional difficulties and causes of administrative law in the protection of intangible cultural heritage, and puts forward countermeasures from multiple perspectives in order to provide new ideas for the legalization of intangible cultural heritage protection.
