我国“二创”短视频的侵权认定研究
Research on Infringement Identification of China’s “Second Creation” Short Videos

短视频平台中二次创作类视频数量日益扩大，原版权方与二次创作视频作者争议不断。本文选取的120个二创短视频侵权案例显示其面临合理使用规则不统一、平台责任落实难及许可方式僵化等困境，进而提出明确合理使用标准及短视频平台注意义务、完善短视频平台管理管理策略、引入行业自律协会和构建数字交易机制等措施，旨在为完善相关法律制度、促进短视频产业健康发展提供理论支持与实践指导，实现著作权人权益保护与创作自由的平衡。
The number of derivative videos on short video platforms is increasing, leading to continuous disputes between original copyright holders and derivative video creators. This article selects 120 cases of derivative video infringements, revealing difficulties in recognizing the originality of videos, inconsistencies in fair use regulations, challenges in implementing platform responsibilities, and rigid licensing methods. It proposes measures such as establishing clear standards for originality recognition and fair use, enhancing the duty of care of short video platforms, improving management strategies for short video platforms, introducing industry self-regulatory associations, and constructing digital trading mechanisms. These measures aim to provide theoretical support and practical gui- dance for improving relevant legal systems and promoting the healthy development of the short video industry, achieving a balance between copyright protection and creative freedom.
