网络犯罪帮助行为的刑法规制——以帮助信息网络犯罪活动罪为考察对象
Criminal Law Regulation of Network Crime Helping Behavior—Taking the Crime of Assisting Information Network Crime as the Object of Investigation

《刑法》第287条之二规定的帮助信息网络犯罪活动罪的性质是帮助行为正犯化，不是帮助犯的量刑规则。网络犯罪的帮助行为发生异化，导致了传统共同犯罪理论在应对此类犯罪时存在打击力度不足和打击范围不够的双重困境，而风险刑法理论为网络犯罪帮助行为正犯化提供了正当性依据，但也面临处罚扩大化的潜在风险，应当从合理认定“明知”、正确理解正犯所实施的“犯罪”和明确与中立帮助行为的界限三方面入手，限缩适用帮助信息网络犯罪活动罪。
The nature of the crime of assisting information network crime stipulated in Article 287 bis of the “Criminal Law” is to help criminalize the act, not to help the offender’s sentencing rule. The dissimilation of the helping behavior of cyber crimes leads to the dual dilemma that the traditional theory of joint crime is insufficient to crack down on such crimes and not enough to crack down on the scope of such crimes. While the theory of risk criminal law provides a legitimate basis for the criminalization of the helping behavior of cyber crimes, but it also faces the potential risk of expanding the punishment. We should limit the application of the crime of helping information network crime from three aspects: reasonable identification of “knowing”, correct understanding of the “crime” carried out by the principal offender and clear and neutral boundary of helping behavior.
