人工智能法立法问题研究——以基本原则为路径
Research on Legislation of Artificial Intelligence Law—Taking the Basic Principle as the Path

人工智能法立法相关工作计划，被列入第十四届全国人大常委会立法规划以及国务院2023年度立法工作计划中。人工智能法的研究重心，已从探讨是否立法转向如何立法。人工智能法的强技术属性注定了其研究方向更注重解决人工智能技术进步给社会带来的影响和挑战。文章从探讨人工智能法的立法必要性出发，进而探讨人工智能法的基本原则应包含公平原则和安全原则，最后为人工智能法立法提供一个基本思路，希望能够通过人工智能法的确立为人工智能的发展保驾护航。
The work plan related to the legislation of Artificial Intelligence Law has been included in the legislative plan of the Standing Committee of the 14th National People’s Congress and the 2023 legislative work plan of the State Council. The focus of research on the AI Law has shifted from discussing whether to legislate to how to legislate. The strong technical attribute of the artificial intelligence method determines that its research direction pays more attention to solving the impact and challenges brought to society by the progress of artificial intelligence technology. This article starts from discussing the legislative necessity of the artificial intelligence law, and then discusses that the basic principles of the artificial intelligence law should include the principle of fairness and the principle of safety. Finally, it provides a basic idea for the legislation of the artificial intelligence law, hoping to escort the development of artificial intelligence through the establishment of the artificial intelligence law.
