家庭暴力犯罪中女性权利的保护问题研究
Research on the Protection of Women’s Rights in Domestic Violence Crimes

家庭暴力如同毒瘾一般，是每个家庭看不到尽头的噩梦，也是社会难以根除的恶疾。家庭暴力作为父权文化发展到极限的一种表现形式，反映出两性社会地位的长期不平等，导致女性作为被传统观念长期规训的弱势一方，极易遭受家庭暴力的侵害。当家暴行为持续升级最终演变为犯罪，其对女性毁灭性的伤害更是不言而喻。本文主要通过分析“家庭”因素对暴力犯罪行为认定的影响、探讨家庭暴力犯罪与一般罪名的关系、家庭暴力犯罪中女性权利的保护现状及困境、家庭暴力犯罪中女性权利的救济这四个方面，以家庭暴力犯罪作为一个切面，对女性权利的保护问题进行展开研究。
Domestic violence is like drug addiction. It is a nightmare that every family cannot see the end of, and it is also a disease that is difficult to eradicate in society. As a manifestation of patriarchal culture developed to its limit, domestic violence reflects the long-term inequality in the social status of the two sexes, which makes women, as the weak party who have been disciplined by traditional concepts for a long time, extremely vulnerable to domestic violence. When domestic violence continues to escalate and eventually evolves into a crime, its devastating harm to women is self-evident. This article mainly analyzes the impact of “family” factors on the identification of violent crimes, explores the relationship between domestic violence crimes and general crimes, the current status and dilemma of the protection of women’s rights in domestic violence crimes, and the relief of women’s rights in domestic violence crimes. Taking domestic violence crimes as a section, this article studies the protection of women’s rights.
