欧盟《数字服务法案》解读及对我国的启示
Interpretation of the Digital Services Act and Its Enlightenment for China

欧盟《数字服务法案》(DSA)为应对数字经济发展中的诸多问题而制定。DSA创建了通知行动机制、受信报告者通知、内部投诉处理等制度，并在用户权利保护、打击非法内容多方参与、主体分级分类管理、协同监督等方面具创新性。我国数字服务治理领域尚属起步阶段，面临监管缺位与新技术挑战等难题。DSA的内容为我国数字服务治理提供了启示，包括制定专门性法律、加强用户权益保护、设立独立监管部门等，以推动我国数字服务治理优化升级，适应数字经济发展需求。
The European Union’s Digital Services Act (DSA) was formulated to address numerous issues arising from the development of the digital economy. The DSA establishes mechanisms such as notice and action mechanism, trusted reporters’ notifications, internal complaint handling, and demonstrates innovation in areas such as user rights protection, combating illegal content with multi-party participation, subject classification management, and collaborative supervision. China’s digital service governance is still in its infancy, facing challenges such as regulatory gaps and new technology challenges. The content of the DSA provides insights for China’s digital service governance, including the formulation of specialized laws, strengthening user rights protection, and the establishment of independent regulatory departments, in order to promote the optimization and upgrading of China’s digital service governance to meet the needs of the digital economy development.
