著作权法视域下知识共享的实现困境和推进路径

知识创新共享是生产力发展的动力机制，法治建设是经济增长的保障机制，二者的互相配合、互相协调激发新质生产力高质量发展。知识共享并不是一个全新的概念与话题，在著作权法领域，对于知识共享的保护已存在一定的框架构建，既包括已在司法实践中应用多年的著作权集中管理制度，也包括未纳入著作权法的著作权开放许可机制和知识共享协议机制。在著作权公共领域不断被限缩的当下，在保护著作权人合法权益的情况下保留充足的空间使知识能够自由地流动分享，能够为创新提供源源不断的资源材料，从而培育、发展新质生产力。
Knowledge innovation and sharing is the driving force mechanism for the development of productive forces, and the construction of the rule of law is the guaranteed mechanism for economic growth. In the field of copyright law, there is a certain framework for the protection of knowledge sharing, including the centralized copyright management system that has been applied in judicial practice for many years, as well as the copyright open licensing mechanism and knowledge sharing agreement mechanism that have not been incorporated into the copyright law. At a time when the public domain of copyright is constantly being restricted, sufficient space should be reserved to enable knowledge to flow and share freely under the condition of protecting the legitimate rights and interests of copyright owners, and to provide a steady stream of resources and materials for innovation, so as to cultivate and develop new quality productivity.
