论宅基地上房屋继承权之行使
On the Exercise of House Inheritance Right on Homestead

房屋是农村个人的合法财产，但是宅基地的所有权属于集体经济组织，房屋所有权与宅基地所有权的分离为房屋继承权的行使带来了一定的麻烦。依据房地一体原则，若继承人继承房屋后也继承了宅基地使用权，则可能会产生与一户一宅原则的冲突。文章通过案例分析，探讨目前关于宅基地使用权的继承与宅基地上房屋继承的立法现状与司法现状，对相关问题进行总结归纳，并针对性提出了一系列建议，旨在完善宅基地上房屋继承权的司法实践。
The house is the legal property of rural individuals, but the ownership of the homestead belongs to the collective economic organization. The separation of the ownership of the house and the ownership of the homestead brings some troubles to the exercise of the right of inheritance of the house. According to the principle of integrating land and property, if the heir inherits the house and inherits the right to use the homestead, there may be a conflict with the principle of one household, one house. Through case analysis, this paper discusses the current legislative and judicial status quo of the inheritance of the right to use the homestead and the inheritance of the house on the homestead, summarizes the relevant issues, and puts forward a series of suggestions aimed at improving the judicial practice of the inheritance of the house on the homestead.
