论大数据时代公民个人隐私的法律保护
On the Legal Protection of Citizens’ Personal Privacy in the Era of Big Data

20世纪以来，随着互联网的普及和我国数字信息技术行业的迅猛发展，大数据作为一种信息资源，提高了大规模存储和处理数据的能力，给公民生活提供了极大的便利，但同时也悄然地将公民的隐私暴露在公共视野。虽然国家已经出台相关政策保护公民隐私权，但目前公民隐私权保护仍存在法律监管不到位，相关法律体系不够完善，企业自律意识低下以及公民维权意识淡薄的问题。基于此，文章以公民隐私权保障为研究对象，通过分析公民隐私泄露的形式以及隐私权保障中存在的问题，从国家、企业、个人的角度提出完善建议，期望进一步提升我国公民隐私权的保障水平。
Since the 20th century, with the popularization of the internet and the rapid development of China’s digital information technology industry, big data, as an information resource, has improved the ability to store and process data on a large scale, providing great convenience to citizens’ lives, but at the same time quietly exposing citizens’ privacy to public vision. Although the state has issued relevant policies to protect citizens’ privacy rights, there are still problems, such as inadequate legal supervision, an imperfect legal system, low self-discipline of enterprises, and weak awareness of citizens’ rights protection. Based on this, this paper takes the privacy protection of citizens as the research object, analyzes the forms of privacy disclosure of citizens and the problems existing in privacy protection, and puts forward improvement suggestions from the perspectives of countries, enterprises, and individuals, hoping further to improve the level of privacy protection of Chinese citizens.
