文物保护工程与建设工程的关系刍议——以2024年修订《文物保护法》为视角
A Preliminary Discussion on the Relationship between Cultural Relic Protection Projects and Construction Projects—From the Perspective of the 2024 Revision of the “Cultural Relics Protection Law”

直至《文物保护法》2024年再次修订，文物保护工程与建设工程的关系尚未厘清，致使文物保护工程缺少匹配的合同制式或者示范文本，普遍借用建设工程合同制式，但又不属于《建筑法》调整范围。《城乡规划法》并未对文物保护工程做出排除性条款，文物保护工程是否需要办理建设工程规划许可证、乡村建设规划许可证悬而未决。文物保护工是存量工程，不涉及改建、扩建、新建的增量建设工程，二者存在本质区别，建议《文物保护法》修改加以区别，与《建筑法》排除性条款相衔接。虽然各个办法对于“建设工程”概念的内涵、外延存在差异，但是并不影响文物保护工程在招投标与政府采购领域参照建设工程实施。
Until the revision of the “Cultural Relics Protection Law” in 2024, the relationship between cultural relics protection projects and construction projects has not been clarified, resulting in a lack of matching contract formats or demonstration texts for cultural relics protection projects. Generally, construction project contract formats are borrowed, but they are not within the scope of adjustment of the “Construction Law”. The “Urban and Rural Planning Law” does not make exclusionary provisions for cultural relic protection projects, and whether cultural relic protection projects need to apply for construction project planning permits or rural construction planning permits is still pending. Cultural relic protection work is a stock project that does not involve incremental construction projects such as renovation, expansion, or new construction. There is a fundamental difference between the two, and it is recommended that the “Cultural Relics Protection Law” be amended to distinguish them and connect them with the exclusionary provisions of the “Construction Law”. Although there are differences in the connotation and extension of the concept of “construction engineering” among various methods, it does not affect the implementation of cultural relics protection projects in the fields of bidding and government procurement with reference to construction engineering.
