体育赛事直播节目著作权性质研究
Research on the Copyright Nature of Live Broadcast of Sports Events

随着社会的快速发展，我国体育产业空前繁荣，体育赛事直播备受欢迎。与此同时，通过网络实时盗播赛事直播节目的行为也越发频繁，进而引发了纠纷。但实践中对于此类案件的审理时常出现同案不同判的情况，其中对于体育赛事直播节目应当如何定性的问题尤为突出。鉴于此，文章以“凤凰网转播案”为例，分析确认体育赛事直播节目的作品属性。同时，借鉴域外经验，结合《著作权法》未完善之处，提出明确独创性标准、将体育赛事直播节目归入“视听作品”的建议，以期使体育赛事直播节目得到更好的保护。
With the rapid development of society, China’s sports industry is unprecedentedly prosperous, and the live broadcast of sports events is becoming more and more popular. At the same time, the behavior of stealing and broadcasting live game programs in real time through the network has become more and more frequent, which has led to disputes. But in practice, there are often different judgments in the same case for the trial of such cases, especially the problem of how to determine the nature of the live broadcast of sports events. In view of this, the article takes the “Phoenix network broadcast case” as an example to analyze and confirm the attributes of sports event live broadcast programs. At the same time, drawing on the experience of foreign countries and combining with the imperfections of the copyright law, this paper puts forward the suggestions of clarifying the originality standard and classifying the live sports events programs as “audio-visual works”, in order to better protect the live sports events programs.
