从严惩治网络暴力的刑事政策研究

网络暴力不同于传统暴力的特征，因此加剧了其行为的危害程度和治理难度，而现实治理存在前置法规制无力、刑法规制失位的困境，为有效遏制高发的网络暴力，提出从严惩治网络暴力的刑事政策。从严惩治网络暴力的刑事政策在强调保护法益的同时避免过度限制言论自由，在赋予网络服务提供者安全管理义务的同时强调国家的治理责任。发挥宽严相济基本刑事政策的制约作用，落实宽严并重、宽严有别的要求，在坚持罪刑法定原则下进行刑法解释，在坚持谦抑原则下扩大网络暴力犯罪圈。
