乡村振兴背景下生态产品价值实现路径及法治保障
The Realization Path and Legal Guarantee of Ecological Product Value under the Background of Rural Revitalization

乡村振兴战略的全面实施，标志着脱贫攻坚战胜利后，“三农”工作的核心任务迎来了历史性的转变。我国广大乡村地域，作为乡村振兴实践的主阵地，蕴藏着极为丰富的生态资源，是生态产品供给的重要源泉。当前，中国广大农村地区的生态产品价值还未能得到充分的转化，法治保障存在欠缺。文章首先深入剖析了生态产品价值实现的本质内涵及其理论基础，进而探讨了三条实现其价值的具体路径：政府主导型生态补偿、市场主导型生态补偿和生态产品产业化。最后文章还从法制建设的角度出发，从立法构建、司法保障及执法实践三个维度构建了全面的法治保障体系，旨在促进生态产品价值实现的稳步落地与深化。
The comprehensive implementation of the rural revitalization strategy marks a historic shift in the core tasks of agriculture, rural areas, and farmers’ work after the victory of poverty alleviation. The vast rural areas in our country, as the main battlefield of rural revitalization practice, contain extremely rich ecological resources and are an important source of ecological product supply. Currently, the value of ecological products in rural areas of China has not been fully transformed, and there is a lack of legal protection. This article first deeply analyzes the essential connotation and theoretical basis of realizing the value of ecological products, and then explores three specific paths to realize their value: government led ecological compensation, market led ecological compensation, and ecological product industrialization. Finally, the article also starts from the perspective of legal construction, and constructs a comprehensive legal protection system from three dimensions: legislative construction, judicial protection, and law enforcement practice, aiming to promote the steady implementation and deepening of the realization of ecological product value.
