延迟退休劳动者权益保护立法问题研究
Research on the Legislation Issues of Protecting the Rights and Interests of Delayed Retirement Workers

伴随着人口老龄化的加速和人口负增长的加剧，我国经济增长的潜力受到限制，逐步迈入了老龄化社会。为了解决人口老龄化带来的问题，我国出台了《关于实施渐进式延迟法定退休年龄的决定》，在实施延迟退休政策的过程中，不可避免地会涉及延迟退休劳动者的权益保护问题，如现行的退休制度在不同行业之间的退休年龄区分度不高、对于高龄再就业的劳动者的权益保护还存在不足等问题。针对这一系列问题，应该加强立法方面的措施，从而更好地保障延迟退休劳动者的权益。
With the acceleration of population aging and the intensification of negative population growth, China’s economic growth potential is limited, and it has gradually entered an aging society. In order to solve the problems brought on by the aging population, China has issued the “Decision on Implementing the Gradual Delayed Statutory Retirement Age”. In the process of implementing the delayed retirement policy, it will inevitably involve the protection of the rights and interests of workers who have delayed retirement, such as the current retirement system’s low distinction between different industries and the insufficient protection of the rights and interests of workers who are re-employed at an advanced age. In view of this series of problems, legislative measures should be strengthened to better protect the rights and interests of workers with delayed retirement.
