短视频版权侵权保护之各方主体责任研究

互联网时代，短视频以其亲民性、多样性的特点引起网络消费者的喜爱，如今具有良好的发展势头，越来越多的人将自己的想法和创意注入到创作的短视频中。但随之产生的短视频版权侵权事件也不断增多，想要保护公众上传优秀作品的积极性，确保短视频产业健康繁荣发展，需要对短视频版权有保护义务的各个责任主体共同出力和配合。分析短视频的概念，明确何种短视频才享有版权保护及构成侵权的情形，从而发现各方责任主体在短视频侵权保护方面所存在的漏洞，针对问题给出实用建议，以期短视频版权受到较为系统的保护。
In the internet era, short videos have aroused the love of online consumers with their people-friendly and diverse characteristics, and now they have a good momentum of development, and more and more people are injecting their ideas and creativity into the short videos they create. However, the number of short video copyright infringement incidents is also increasing, and in order to protect the public’s enthusiasm for uploading excellent works and ensure the healthy and prosperous development of the short video industry, it is necessary for all responsible entities with the obligation to protect short video copyright to work together and cooperate. This paper analyzes the concept of short video, clarifies what kind of short video enjoys copyright protection and what constitutes infringement, so as to find the loopholes in the infringement protection of short videos by all responsible parties, and gives practical suggestions for the problems, so as to ensure that the copyright of short videos is protected more systematically.
