人工智能在司法领域中的深度应用，有效缓解了当前司法体系中“案多人少”的突出矛盾，同时为解决“同案不同判”的难题提供了全新思路。然而，人工智能在司法审判中的应用尚处于起步阶段，其在具体实践中仍面临着技术难题不易攻克、冲击法官主体地位、侵犯当事人诉讼权利等诸多风险和挑战。故亟需在技术规制、基本立场及权利保障三个层面提出具体的优化路径，旨在未来的“人机协作”模式下，充分发挥人工智能的应用潜能和辅助功能，建立以法官为主体、人工智能为辅助的司法审判体系，为人工智能在司法审判中的健康有序发展提供有力保障。
The in-depth application of artificial intelligence in the judicial field alleviates the contradiction of “more cases but fewer judges” and offers a new solution to “different judgments for the same case”. However, its application in judicial trials is still in the early stages and faces risks like technical problems, impacts on judges’ status, and infringements on litigants’ rights. Thus, specific optimization paths at three levels of technical regulation, basic stance, and rights protection are needed to fully play its potential and function in the “human-machine collaboration” model, establish a judicial trial system with judges as the main body and artificial intelligence as the auxiliary, ensuring its healthy and orderly development.
