明清医疗事故司法鉴定程序的法律分析和现代借鉴
Legal Analysis and Modern Reference of Medical Malpractice Judicial Appraisal Procedures in the Ming and Qing Dynasties

我国学界对古代司法鉴定程序的研究已颇为深入，纵观研究成果，多为宏观上审视思考中国古代司法检验鉴定制度变迁。精确到医疗事故检验鉴定的司法程序领域，史料颇为不足，但明清法律专门规定了医疗事故司法鉴定的程序，于现代医疗司法鉴定制度方面颇有研究和借鉴意义。本文视角集中于微观视角明清司法鉴定程序领域，对相关律文进行分析，得出明清医疗事故司法鉴定程序专业化、精细化程序法的特点，最后在此基础上针对当代中国医疗司法鉴定制度改革，从明清程序法规定处得出启示。
China’s academic research on the ancient forensic identification program has been quite in-depth, throughout the research results, mostly for the macro review of ancient China’s judicial inspection and appraisal system changes. Precise to the judicial process of medical malpractice testing and appraisal of the field, the historical data is quite insufficient, but the Ming and Qing dynasty law specifically provides for the medical malpractice judicial appraisal of the procedures in the modern medical forensic system is quite a research and reference significance. This paper focuses on the micro perspective of the Ming and Qing dynasties judicial appraisal procedures, the analysis of the relevant legal texts, the Ming and Qing dynasties medical malpractice judicial appraisal procedures specialization, refinement of the characteristics of the procedural law, and finally on this basis for the reform of contemporary China’s medical forensic system, from the Ming and Qing dynasties procedural law provisions of the revelation.
