监管视角下规范我国数据交易市场的研究
Research on Regulating China’s Data Trading Market from a Regulatory Perspective

数字经济时代，数据作为新的生产要素，创造了丰富的经济价值，为我国经济高质量发展注入新动能。同时数据作为一种新的交易产品在实践也存在着数据产权制度缺失、数据定价机制和标准不明晰不规范、数据交易流通市场受阻、数据安全无法得到有效保障等诸多交易困境，这些困境阻碍了数据资产的交易，也限制了数据价值的释放和挖掘。鉴于此，本研究从强化数据交易监管的视角出发，通过构建数据产权制度、加强数据交易流通市场的监管、强化数据定价机制和法律标准的监管以及提升数据交易安全的监管能力四个方面，从而构建规范我国数据交易的法律制度。
In the digital economy era, data, as a new production factor, has created substantial economic value and injected new momentum into the high-quality development of China’s economy. However, as a new type of transaction product, data faces numerous transactional challenges in practice, including the absence of a data property rights system, unclear and non-standard data pricing mechanisms and standards, obstacles in the data trading and circulation market, and ineffective guarantees for data security. These challenges hinder the trading of data assets and limit the release and exploration of data value. In light of this, this study, from the perspective of strengthening data transaction regulation, proposes to establish a legal system for regulating data transactions in China through four aspects: constructing a data property rights system, enhancing the regulation of the data trading and circulation market, strengthening the regulation of data pricing mechanisms and legal standards, and improving the regulatory capabilities for data transaction security.
