人身安全保护令制度实施中存在的问题及对策建议——以毕节市基层法院相关案件为视角
Problems Existing in the Implementation of Personal Safety Protection Order System and Countermeasures—From the Perspective of Relevant Cases in the Basic Court of Bijie City

自《反家庭暴力法》正式设立人身安全保护令这一重要制度以来，在打击家庭暴力行为、保护受害者人身安全方面，这一制度确实发挥了它应有的作用，取得了一定的成效。然而，在司法实践的深入探索中，该制度面临的多重挑战与问题逐渐显现，致使其潜在效能尚未得到全面释放。为深入剖析这一现象并寻求优化路径，本研究聚焦于毕节市基层人民法院自2021年1月1日至2024年3月期间受理的人身安全保护令案件，通过细致分析，旨在揭示存在的问题，并据此提出一系列针对性强、具有可操作性的改进建议，可以进一步完善人身安全保护令制度，确保其在预防和制止家庭暴力行为中，能够发挥出更加充分且有效的作用。
Since the “Anti-Domestic Violence Law” formally established the important system of personal safety protection order, this system has indeed played its due role and achieved certain results in combating domestic violence and protecting the personal safety of victims. However, in the in-depth exploration of judicial practice, the multiple challenges and problems faced by the system have gradually emerged, so that its potential effectiveness has not been fully released. In order to deeply analyze this phenomenon and seek an optimized path, this study focuses on the cases of personal safety protection orders accepted by Bijie grassroots people’s courts from January 1, 2021 to March 2024. Through detailed analysis, the purpose is to reveal the existing problems, and accordingly put forward a series of targeted and operable suggestions for improvement, which can further improve the personal safety protection order system and ensure that it can play a more full and effective role in preventing and stopping domestic violence.
