An Analysis of the E-C Translation of the United Nations Convention on Contracts for the International Sale of Goods from the Perspective of “Faithfulness, Expressiveness, and Elegance” Theory

《联合国国际货物销售合同公约》(《销售公约》)是在统一国际商法的广泛领域方面公认的最成功的尝试。这一自动执行的条约通过制订公平和现代实质性法规，规范国际销售合同当事方的权利和义务，旨在减少国际贸易的障碍，特别是那些与法律选择有关的障碍。当今世界全球化势不可挡，中国对国际贸易的需求日益增加，1988年的中文版《联合国国际货物销售合同公约》(CISG)成为中国在国际贸易当中必不可少的一个参考文件。该分析是以《销售公约》的英汉平行文本为对象，在严复“信达雅”理论指导下，对《销售公约》汉译中采用的相关翻译原则、方法和技巧进行归纳总结。对《销售公约》汉译进行对照分析，有助于笔者了解《销售公约》的具体内容，学习国际货物销售方面的专业知识；加深笔者对公约文本特点和语言结构的认识和了解，能够有针对性地选择相关翻译方法，提高翻译这类文本的能力和技巧。此外，该分析还可以为对这一领域翻译感兴趣的相关人士提供参考，为翻译学习者首次翻译这类文本提供相关经验。
The United Nations Convention on Contracts for the International Sale of Goods (CISG) is recognized as the most successful attempt at unifying a broad area of international commercial law. This self-executing treaty aims to reduce obstacles to international trade, especially those related to choice of law, by establishing fair and modern substantive regulations governing the rights and obligations of parties to international sales contracts. In today’s unstoppable world of globalization and China’s increasing demand for international trade, the Chinese version of the United Nations Convention on Contracts for the International Sale of Goods (CISG) in the year of 1988 has become an essential reference document for China in international trade. This analysis summarizes the principles, methods and techniques used in the Chinese translation of CISG under the guidance of Yan Fu’s “faithfulness, expressiveness and elegance” theory, taking the English and Chinese parallel text of CISG as the object. The analysis of the Chinese translation of the CISG helps the author understand the specific contents of the CISG and learn the professional knowledge of international sale of goods; deepen the author’s knowledge and understanding of the characteristics and linguistic structure of the text of the Convention, enable readers to select relevant translation methods in a targeted manner, and improve their ability and skills in translating this kind of text.
