《未成年人保护法》修订背景下对校园欺凌的法律反思

Abstract:
随着社会的迅猛进步与未成年人保护问题的不断凸显,我国《未成年人保护法》经历了多次审慎而全面的修订,以期达到对未成年人更为细致、周全的保护。在此背景下,本文聚焦于校园欺凌这一备受关注的社会议题,在《未成年人保护法》最新修订的框架下,展开了深入的法律反思。文章旨在探讨当前法律体系中针对校园欺凌的保护措施、存在的不足之处。通过对校园欺凌的定义、普遍现状、深远危害以及现行法律规制进行综合剖析,并结合修订后的《未成年人保护法》相关内容,我们提出了一系列旨在加强校园欺凌防治的法律对策,旨在为未成年人的身心健康提供更有力的法律保障,助力构建和谐美好的社会环境。
With the rapid progress of the society and the continuous prominence of the protection of minors, China’s “Law on the Protection of Minors” has undergone many prudent and comprehensive revisions, in order to achieve a more detailed and comprehensive protection of minors. In this context, this paper focuses on the social issue of school bullying, and launches an in-depth legal reflection under the framework of the latest revision of the “Law on the Protection of Minors”. This paper aims to explore the protection measures against bullying in the current legal system, the existing deficiencies. Through a comprehensive analysis of the definition, universal status, far-reaching harm and existing legal regulations of bullying in schools, and combined with the relevant contents of the revised “Law on the Protection of Minors”, we propose a series of legal countermeasures aimed at strengthening the prevention and treatment of bullying in schools, aiming at providing more powerful legal protection for the physical and mental health of minors and helping to build a harmonious and beautiful social environment.
