数字平台用工劳动权益保障研究

Abstract:
数字经济下,平台用工的规模不断扩大,这种就业方式不仅能够给予劳动者较大的自主性,满足劳动者的现实需要,也极大地缓解了我国的就业压力。但在现实社会中,由于平台从业者劳动关系的认定陷入困境,导致了其劳动权益也难以得到有效保护,这不利于劳动关系和谐稳定的同时,也深刻影响着数字经济的可持续发展。因此,本文从数字平台用工劳动权益保障的现状出发,结合我国发展现状,提出了完善平台用工劳动权益保障的对策,以期能够促进劳资关系的和谐稳定。
Under the digital economy, the scale of platform employment continues to expand, and this employment method can not only give workers greater autonomy, meet the practical needs of workers, but also greatly alleviate the employment pressure in our country. However, in the real society, due to the difficulties in the identification of labor relations of platform practitioners, it is difficult to effectively protect their labor rights and interests, which is not conducive to the harmony and stability of labor relations, but also profoundly affects the sustainable development of the digital economy. Therefore, this paper, based on the status quo of the protection of labor rights and interests of digital platforms, combined with the development of our country, puts forward countermeasures to improve the protection of labor rights and interests of digital platforms, in order to promote the harmony and stability of labor relations.
