未成年人在直播平台上的打赏行为引发了一系列问题，包括潜在的财务风险和不法分子的不当诱导等，研究这些问题对于规范直播行业和保护未成年人权益至关重要。本文阐述了规制未成年人直播打赏行为的必要性，在研究现状的基础上提出当前我国规制未成年人直播打赏行为所面临的直播平台监管责任难以界定、未成年人身份识别与验证面临难题这两大困境，并从加强直播平台的自我监管、明确家长与社会的共同责任这两方面提出了解决我国未成年人网络直播打赏问题的具体对策。
The behavior of minors making donations on live streaming platforms has raised a series of issues, including potential financial risks and improper inducement by criminals. Researching these problems is crucial for regulating the live streaming industry and protecting the rights and interests of minors. This article discusses the necessity of regulating the behavior of minors making donations on live streaming, identifies two major challenges based on the current research situation: the difficulty in defining the regulatory responsibilities of live streaming platforms and the challenges faced in identifying and verifying the identities of minors. It also proposes specific countermeasures to address the issue of minors making donations on live streaming in China from two aspects: strengthening the self-regulation of live streaming platforms and clarifying the joint responsibilities of parents and society.
