论司法实践中性侵未成年人犯罪认定的现实困境和对策
On the Practical Predicament and Countermeasures of the Identification of the Crime of Sexual Assault against Minors in Judicial Practice

未成年人在我国发展过程中始终具有无可比拟的重要地位及作用，因此保障未成年人的健康成长非同儿戏，这是家庭、社会乃至国家的责任。然而对未成年人的性侵仍然存在，在一些地方竟呈上升趋势。这不仅严重挑战道德和原则，而且对未成年人的人身安全产生了负面影响，对其成长构成了诺大的威胁。所以，加强对性侵未成年人犯罪案件的认定以及证据的审查，提高对未成年人的保护力度是守护未成年人健康成长的应有之义。通过对大量未成年性侵案件的研究，总结未成年人性侵犯的现状及危害，分析案件特点，重点分析性侵未成年人犯罪认定的困境及对办理性侵未成年人犯罪案件中的诸多问题提出相应的完善建议与应对策略。
Minors have always played an incomparably important role in the development of our country, so ensuring the healthy growth of minors is not a child’s play, and it is the responsibility of the family, society, and even the state. However, sexual abuse of minors persists, and in some places is on the rise. This not only seriously challenges morality and principles, but also has a negative impact on the personal safety of minors and poses a great threat to their development. Therefore, strengthening the identification of cases of sexual assault against minors, the review of evidence, and increasing the degree of protection for minors are the proper meaning of protecting the healthy growth of minors. Through the study of a large number of juvenile sexual assault cases, this paper summarizes the current situation and harms of juvenile sexual assault, analyzes the characteristics of the cases, focuses on the analysis of the dilemma of the identification of sexual assault on minors, and puts forward corresponding suggestions and coping strategies for many problems in handling juvenile sexual assault cases.
