论中药的知识产权保护路径探析

中药作为我国的宝贵文化遗产，不仅解决了民众的健康问题，也留下了许多珍贵的中药理论、中药复方等医药资源，然而当前国际社会的医药保护体系大多都是为了保护化学成药而设立，以专利权保护为首位，药品保护、著作权保护、中医药标准化为补充的权利保护体系，专利权保护中“三性”要求与中药存在冲突，药品保护、著作权保护、中医药标准化制度不完善，亟待构建一个完善的发明专利体系，以商业秘密作为补充的中药权利保护体系。
As a valuable cultural heritage of our country, traditional Chinese medicine not only solves the health and cultural problems of the people, but also leaves many precious traditional Chinese medicine theories, traditional Chinese medicine compounds and other medical resources, but most of the current medical protection system of the international community is established for the protection of chemical medicines, with patent protection as the first place, drug protection, copyright protection, and traditional Chinese medicine standardization as the supplementary rights protection system, and there is a conflict between the “three sexes” requirements in patent protection and traditional Chinese medicine, and the drug protection, copyright protection, and traditional Chinese medicine standardization system are not perfect. There is an urgent need to build a complete invention patent system, which is more suitable for the protection of rights of traditional Chinese medicine supplemented by trade secrets.
