Abstract:

自《学位条例》颁布以来,我国经济和教育事业发生较大变化,原先的《学位条例》已不能满足新时代需求。《学位法》的出台,其先进性体现在制度内容的全面与创新、权益保障与质量保障的强化以及立法理念与时代发展的契合。然而学生在学术规范问题上的相关法律意识淡薄;相关的规章制度与《学位法》不够匹配;牵涉多方主体容易产生潜在问题三方面的困难阻碍了《学位法》的落实,对此,各方主体应当加强师生的法律教育和学术规范教育;完善配套的规章制度以促进《学位法》的落实;加强多方主体之间的沟通与协作。通过以上这些策略,促进《学位法》的落实。
Since the promulgation of the “Regulations on Academic Degrees”, China’s economy and education have undergone great changes, and the original “Regulations on Academic Degrees” can no longer meet the needs of the new era. With the introduction of the “Degree Law”, its advancement is reflected in the comprehensiveness and innovation of the system content, the reinforcement of rights and interests and quality assurance, and the compatibility of the legislative concept with the development of the times. However, the implementation of the “Law on Academic Degrees” is hindered by the weak legal awareness of students on academic norms, the insufficient matching of related regulations with the “Law on Academic Degrees”, and the potential problems that may arise from multi-party subjects, for which all parties should strengthen the education of teachers and students on legal education and academic norms, improve the supporting regulations to promote the implementation of the “Law on Academic Degrees”, and strengthen the communication and collaboration among multi-party subjects and collaboration among the main parties. Through these strategies, the implementation of the “Law on Academic Degrees” can be promoted.
