影视解说类短视频的著作权侵权问题研究

随着互联网技术的迅猛发展，短视频作为一种新兴的娱乐形式迅速崛起，成为人们获取信息和娱乐的重要渠道。其中，影视解说类短视频选取作品的核心内容和故事主线情节，利用原影视作品素材加工成精简版并融入一定的解说或评论。这类短视频以其独特的解说方式和深入的观影体验，吸引了大量观众。然而，由于这类短视频制作者通常是未经著作权人许可，对电影作品进行剪辑拼接并上传至网络进行传播，如果这种行为不属于《著作权法》规定的合理使用的范围，则侵犯了电影作品著作权。本文将从影视解说类短视频的概念出发，分析其著作权侵权问题，并提出相应的对策与建议。
With the rapid advancement of Internet technology, short videos, as an emerging form of entertainment, have risen rapidly and become a crucial channel for people to acquire information and entertainment. Among them, short videos of film and television commentary select the core content and main storyline of the works, process the original film and television works’ materials into a condensed version, and incorporate certain explanations or comments. Such short videos have attracted a large number of viewers with their unique commentary methods and in-depth viewing experiences. However, since these short video producers typically edit and splice film works without the permission of the copyright holders and upload them to the Internet for dissemination, if this behavior does not fall within the scope of reasonable use stipulated in the “Copyright Law”, it infringes upon the copyright of the film works. This article will commence from the concept of short videos of film and television commentary, analyze the copyright infringement issues, and propose corresponding countermeasures and suggestions.
