浅谈宋代女性在婚姻缔结中的法律地位
Introduction to the Legal Status of Women in the Conclusion of Marriage in the Song Dynasty

宋代以来，随着科举制度的进一步完善、“重文抑武”形成的稳定政治环境、“不抑土地兼并”的土地政策改革，使得较为宽松的商业政策得以建立，宋代的商品经济得到了前所未有的发展。经济的发展牵动了传统的社会观念受到冲击，“农本商末”的思想观念也发生了动摇，从而引起了文化教育的兴盛，促进了社会思想的活跃和观念的更新。在此经济社会繁荣、社会观念进步的时代背景下，女性的社会地位，尤其是法律地位得到了很大的改善。本文意图以宋代女性的婚姻缔结特征为切入点，结合现有文献成果，总结相较于前朝的独特性，从而探析宋代女性在婚姻缔结中的法律地位。
Since the Song Dynasty, with the further improvement of the imperial examination system, the stable political environment formed by “emphasizing literature and suppressing the military”, and the reform of the land policy of “not suppressing land annexation”, which made it possible to establish a more liberal commercial policy, the commodity economy of the Song Dynasty got an unprecedented development. The commercial economy of the Song Dynasty experienced unprecedented development. The development of the economy led to the impact of the traditional social concepts, “agriculture-based business” ideological concepts have also been shaken, which led to the prosperity of culture and education, promoting active social thinking and conceptual renewal. Against this background of economic and social prosperity and progress in social concepts, the social status of women, especially their legal status, was greatly improved. This paper intends to take the characteristics of women’s marriage contraction in the Song Dynasty as a starting point, combine the results of existing literature, summarize the uniqueness compared with the previous dynasty, and thus explore the legal status of women’s marriage contraction in the Song Dynasty.
