我国离婚经济补偿制度的研究

离婚经济补偿制度，是对在婚姻中投入大量家务劳动的一方给予的经济上的认可和补偿。它不仅有助于夫妻双方婚姻利益的平衡，也促进了实质意义上的平等，确保了家庭成员间的合理分担。我国《民法典》对该制度作出进一步完善，无论是采取分别财产制还是共同财产制，只要一方在婚姻关系中承担了较多的家庭义务，当双方离婚时就可以请求对方给予经济补偿，而不受财产制类型的限制。但现阶段，该制度仍存在一些问题，如当事人举证困难、补偿标准不明确、行权时间的限制、未考虑女性牺牲的人力资本等，基于此，提出了相应的完善建议，包括优化举证责任、明确补偿标准、延长行权时间、保障女性权益。
The divorce economic compensation system is an economic recognition and compensation given to the party who has invested a large amount of household labor in the marriage. It not only helps to balance the interests of both spouses in marriage, but also promotes substantive equality and ensures reasonable sharing among family members. The “Civil Code” of our country has further improved this system. Whether adopting a separate property system or a joint property system, as long as one party has undertaken a significant amount of family obligations in the marital relationship, when both parties divorce, they can request economic compensation from the other party without being restricted by the type of property system. However, at present, there are still some problems with the system, such as difficulties in providing evidence for the parties involved, unclear compensation standards, limitations on exercise time, and failure to consider the human capital sacrificed by women. Based on this, corresponding improvement suggestions have been proposed, including optimizing the burden of proof, clarifying compensation standards, extending exercise time, and safeguarding women’s rights and interests.
