我国专利池运营的问题与对策
The Problems and Countermeasures of Patent Pool Operation in China

目的：在全球专利池构建中，我国虽然积极参与，但在具体的运营模式和管理理念上仍需改进。有必要识别存在的问题，提出切实可行的解决方案。方法：采用案例分析和比较分析等方法。结果：认为我国专利运营存在机制不成熟、管理能力待提升、核心专利资源不足、运营主体分散等四个方面。结论：建议推进专利池运营政策的系统化和法治化，建立由相应政府部门牵头设立的专利池管理机构，提升专利池运营的核心专利资源，实现知识产权运营主体协同发展。
Purpose: Although China actively participates in the construction of the global patent pool, there is still room for improvement in specific operational models and management concepts. It is necessary to identify existing problems and propose practical and feasible solutions. Method: Adopting methods such as case analysis and comparative analysis. Results: It is believed that there are four aspects in China’s patent operation, including immature mechanisms, need for improvement in management capabilities, insufficient core patent resources, and scattered operating entities. Conclusion: It is recommended to promote the systematization and legalization of patent pool operation policies, establish patent pool management institutions led by corresponding government departments, enhance the core patent resources of patent pool operation, and achieve the coordinated development of intellectual property operation entities.
