我国家事纠纷解决机制的困境与出路
The Dilemma and Way out of China’s Civil Dispute Resolution Mechanism

近年来，随着家事纠纷案例的增加，家庭的不睦越来越影响社会和谐的实现，需要探索和采纳有效的司法策略以应对这一挑战以及不断涌现的新矛盾。文章首先界定了家事纠纷的范畴，并强调了其在维护社会稳定中的重要作用。随后，系统梳理了现行的诉讼与非诉讼解决机制，包括和解、调解、仲裁及司法诉讼等，并指出了这些机制在实际操作中存在的问题，如缺乏专门立法支持、适用依据不足、专业化审理机构和人员配备不足等。针对这些问题，本文提出了一系列改进对策，包括完善家事诉讼立法、划分家事纠纷类型，以及加强专业化审理机构和人员的建设。通过深入探讨家事纠纷解决机制的困境与出路，本文期望能为推动家事纠纷解决机制的持续改进和发展贡献力量。
In recent years, with the increase in family dispute cases, family disharmony has increasingly affected the realization of social harmony, and it is necessary to explore and adopt effective judicial strategies to deal with this challenge and the emerging new contradictions. The article first defines the scope of family disputes and emphasizes their important role in maintaining social stability. Subsequently, the current litigation and non-litigation resolution mechanisms, including reconciliation, mediation, arbitration and judicial litigation, were systematically sorted out, and the problems existing in the actual operation of these mechanisms were pointed out, such as the lack of special legislative support, insufficient basis for application, and insufficient professional trial institutions and staffing. In view of these problems, this paper proposes a series of improvement measures, including improving the legislation on family litigation, classifying the types of family disputes, and strengthening the construction of professional trial institutions and personnel. By in-depth discussion of the dilemma and way out of the family dispute resolution mechanism, this paper hopes to contribute to the continuous improvement and development of the family dispute resolution mechanism.
