浅析我国中医药知识产权保护的问题与对策
An Analysis of the Issues and Countermeasures Regarding Intellectual Property Rights Protection of Traditional Chinese Medicine in Our Country

中医药是中华民族传统医药的瑰宝，具有悠久的历史和深厚的文化底蕴。但是，近年来的数据显示，我国中医药知识产权保护面临着诸多风险挑战。当前，我国中医药知识产权保护存在着中医药知识产权保护意识缺乏、中医药知识产权保护制度体系尚不完善、中医药知识产权保护的国内和国际衔接不到位的问题。究其原因，是由重视西药技术而忽视中医药特别是公知领域内瑰宝中医药、中医药保护体系同源自西方的知识产权知识技术体系不同、中医药知识产权具有鲜明中国特色难以自行适应国际市场所造成。针对前述问题，可采取增强中医药知识产权保护意识、完善中医药知识产权保护制度体系、积极主导参与中医药知识产权保护国际立法并加强衔接的策略。
Traditional Chinese medicine (TCM) is a treasure of traditional Chinese healthcare, endowed with a long history and profound cultural heritage. However, recent data indicates that the protection of intellectual property rights (IPR) for TCM in our country is facing numerous risks and challenges. Currently, there are issues such as a lack of awareness regarding the protection of TCM IPR, an incomplete system of IPR protection regulations for TCM, and inadequate domestic and international coordination in TCM IPR protection. The reasons for these issues include a focus on Western pharmaceutical technology at the expense of TCM, especially the treasures of traditional Chinese medicine within the publicly recognized domain, differences between the TCM protection framework and the Western-originated IPR knowledge and technology system, as well as the distinct Chinese characteristics of TCM IPR that make it difficult to adapt spontaneously to the international market. In response to these problems, strategies could be adopted such as enhancing awareness of TCM IPR protection, improving the system of TCM IPR protection regulations, actively leading and participating in international legislation concerning TCM IPR protection, and strengthening coordination efforts.
