Abstract:

近年来,快递业随着网络经济的飞速发展而兴起,这已是中国人生活的一个重要组成部分。但是,由于发展太快,法律存在一定的滞后,由此引发了一系列的问题,如快递纠纷案件激增,消费者权益得不到相应的保护,快递服务质量越来越差等。当快递服务受到侵害时,如何维护快递服务中的消费者权利是一个很有意义的问题。文章就如何在我国快递行业中损害消费者利益的法律问题进行了研究,并对此进行了探讨。消费者权益受侵害原因从整体上看主要是我国现有法律法规不健全、快递服务行业自律能力较差、部门监管不到位。维护快递服务消费者合法权益一方面需要完善相关法律,另一方面需要加强市场监管、成立行业协会、增强行业自律能力,从而促进快递行业稳定健康发展和切实保障消费者合法权益。
In recent years, the express delivery industry rises with the rapid development of network economy, and it has become an indispensable part of the life of the Chinese people. However, the speed of development is too fast, but the law has a lag, so it brings a series of problems, mainly in the form of express dispute cases increase, consumer rights and interests cannot be protected, express service quality is deteriorating. In the express service suffered infringement, the protection of consumer rights and interests in express delivery services is worth studying. This paper focuses on the legal problems of consumers’ rights and interests damaged in China’s express service, and puts forward the ways to solve the problems. There are many reasons for the damage to the rights and interests of consumers, in general, mainly the imperfect existing laws and regulations in China, the poor self-discipline of the express service industry, and the inadequate supervision of departments. In order to protect the legitimate rights and interests of consumers in express delivery services, on the one hand, we should improve relevant legislation, on the other hand, we should also strengthen market supervision, establish industry associations, strengthen industry self-discipline, and effectively safeguard the legitimate rights and interests of consumers.
