Abstract:

“数字丝路”背景下区块链电子提单法律互通机制的构建符合当前国际贸易数字化的现实需求。本研究针对区块链电子提单在法律定性、司法管辖、数据主权等方面面临的挑战,提出了完善立法框架、构建多层次责任分配体系、加强跨境数据流动管理以及建立在线专项争议解决平台等建议。“数字丝路”为区块链电子提单的法律互通提供了重要机遇,未来将朝着更完善的数字基础设施、更可靠的技术支持、更广泛的国际共识以及更开放包容的合作机制方向发展。
The construction of a legal interoperability mechanism for blockchain-based electronic bills of lading under the backdrop of the “Digital Silk Road” aligns with the current practical needs of inter- national trade digitalization. This study addresses the challenges faced by blockchain-based electronic bills of lading in terms of legal characterization, judicial jurisdiction, and data sovereignty, proposing recommendations such as improving the legislative framework, establishing a multi-level liability allocation system, enhancing cross-border data flow management, and creating an online specialized dispute resolution platform. The “Digital Silk Road” provides significant opportunities for the legal interoperability of blockchain-based electronic bills of lading, with future developments moving towards more robust digital infrastructure, more reliable technical support, broader international consensus, and more open and inclusive cooperation mechanisms.
