数字法学的逻辑构建与实践路径

随着数字化技术的发展浪潮席卷全球，在此基础上发展而来的法律问题促进了数字法学的发展和产生，并且数字法学的逻辑构建与实践路径成为了当前研究的基础。基于现有的数字法学研究问题领域不明确，对于数字法学的研究主要集中在关于数字发展构建技术以及构建在现有的法学理论体系中。另外，数字法学研究始终受传统法律理论框架的限制，而缺乏现代化、科学化的数字法学逻辑建构。面对当前数字法学建设路上存在的问题领域和理论建构两个方面的研究不足，本研究主要对数字法学这一法学的研究新范式的本质进行研究。即站在全局观念的系统思维下，坚持数字技术与法治系统的良性互动，推动数字法学治理体系开放多元化，满足数字化技术发展需求。通过梳理数字法学理论研究范式的基础上，寻找数字法学构建的逻辑路径和实践方法，以满足数字技术发展的数字法学实践路径。
With the development wave of digital technology sweeping the world, the legal problems developed on this basis have promoted the development and emergence of digital law, and the logical construction and practical path of digital law have become the basis of current research. Based on the existing digital law research field is not clear, the research on digital law mainly focuses on the digital development and construction technology and the construction in the existing legal theory system. In addition, the study of digital law is always limited by the traditional legal theoretical framework, but lacks the modern and scientific logical construction of digital law. In the face of the shortcomings of the problem field and the theoretical construction, this study mainly studies the nature of digital law, the new paradigm of law research. In order to find the logical path and practical method of digital law construction, on the basis of combing the research paradigm of digital law theory, so as to meet the practice path of digital law in the development of digital technology and information explosion.
