新《著作权法》视域下短视频侵权案件中合理使用条款的实践图景、法理与完善——基于126份判决书的实证研究
Practical Prospect, Jurisprudence and Perfection of Fair Use Clause in Short Video Infringement Cases from the Perspective of the New “Copyright Law”—An Empirical Study Based on 126 Judgments

2020年新修订的《著作权法》对于合理使用条款进行了诸多调整。通过对126份判决书的实证研究发现，尽管合理使用条款旨在平衡著作权人和公众利益，但在司法实践中仍穷尽式列举立法滞后于短视频产品模式、法院对于“合理使用”相关法理理解有偏差、对于原则性条款适用标准不一等问题。对此，应通过完善合理使用制度，加强实质性审查、结合不同因素综合考量赔偿金额、完善原则性条款的适用规则等优化进路，从而保证短视频侵权案件判决的公正性和一致性，规范短视频行业的发展。
The 2020 revision of the “Copyright Law” has made several adjustments to the fair use provisions. An empirical study of 126 judgments reveals that although the fair use provisions aim to balance the interests of copyright holders and the public, judicial practice still faces issues such as exhaustive legislative listing lagging behind the short video product model, courts’ misinterpretation of fair use principles, and inconsistent application standards for principle-based provisions. In response, it is necessary to improve the fair use system by strengthening substantive review, considering various factors comprehensively when determining compensation amounts, and refining the application rules of principle-based provisions. These optimization approaches will ensure the fairness and consistency of judgments in short video infringement cases and regulate the development of the short video industry.
